Great Criminal Defense FAQ from Our Buddy, Attorney Dr. Adrian King in Ohio

publication in agreement with the hamburg poli...Image via Wikipedia

Here are some great criminal defense questions for residents of Ohio from expert attorney Adrian King, who just published a similar FAQ on Ohio bankruptcy law here...

Q. How are different drug offenses classified?

A. Drugs are classified by federal guidelines and punishment is determined based on the classification of the drug involved in the crime. There are forty three base offense levels for drug related crimes, and levels can be added or subtracted depending on the details of the case. Sentencing is harsher on higher level offenses.

Q. Can my home be searched without a warrant?
A. If you allow a police officer into your home and consent to a search,, then the police officer may conduct the search without a warrant. Anything found or collected during the search can be used against you if your case goes to trial. If you do not consent to a search of your home, then a police officer must show probable cause to a judge in order to obtain a warrant granting them permission to search your home without your consent.

Q. Is it legal for police officers to use force when arresting a suspect?
A. Police officers are permitted to use “necessary” force when making an arrest. The force should be limited to reasonable force used only to facilitate the arrest. Assault is not permitted. Scholarships for disadvantaged students from single parent households

I would like to personally commend Larry and his staff for giving back to their communities. These days it seems that most businesses are run by heart-less corporations who don't give a dam about the people anymore, but thank goodness there are still people out there like Larry Parker!

Larry H. Parker: "Every year, 20 scholarships will be presented to high school students in California and Arizona who exhibit a commitment to improving their community through service and education."

FindLaw Still Top Online Legal Destination

According to Compete.com, FindLaw is still ahead of the pack by a large margin, one million unique visitors per month to be exact. Justia has made large strides this year though, with a 144% jump in unique visitors per month.

Honorable mention goes out to HG.org, who did not make the chart above, but is making large strides this year also, and has even been spotted ahead of the big guys on some important Google Searches.

Google Looses Small Case and Hopefully Learns Lesson

Image representing Google as depicted in Crunc...Image via CrunchBase

Aaron Greenspan: Why I Sued Google (and Won): "'Google can terminate your account for any reason,' she told me.

'Not any reason,' I said. 'Not because I have blue eyes. Or brown eyes.'"

I am glad Aaron fought back on this one. Google's policies definitely need some reworking. They have grown too big too fast and the little guy once again got lost in the fray.

GOOGLE (GOOG): You better be keeping records if you are going to be handing out penalties like a trigger happy cowboy!

Controversial Perfume Decision - Workers Comp Law in NJ

Metropolitan statistical areas and divisions o...Image via Wikipedia

Here is an excellent case analysis about a controversial workers' compensation decision in New Jersey. While explaining the case, the attorney, Kenneth A. DiMuzio Sr., gives us a great understanding of workers' compensation law in New Jersey.

The Perfume Decision - The Fragrant Aroma Of A Just Result: Case Study on Workers Comp Law in New Jersey: "Contrary to the opinion of some critics, the holding does not stink. The furor expressed by those opposed to the decision is based upon a fundamental misunderstanding of the principles of N.J. workers' compensation law." Read the rest here...

Worst Downturn For 100 Years - say it aint so Ed!

Through the Great DepressionImage by B Tal via Flickr

Balls Predicts 'Worst Downturn For 100 Years': "Ed Balls made the remarks in a speech at a Labour conference yesterday, the Yorkshire Post reports. If the forecast proves correct, it would mean that the current recession outstrips in severity the 1930s downturn, which saw the Great Depression in the US and the rise of authoritarian regimes across Europe."

I am praying the experts are wrong, but how often does that happen. Well I guess its time to invest in shotguns and canned goods, lol

I wonder if the Bush administration feels any responsibility for this?

Great post from Change.org - Hiding the Homeless: Super Bowl Edition

Fitzgerald Makes A Move On HuffImage by jndotcom via Flickr

End Homelessness - Change.org: Hiding the Homeless: Super Bowl Edition: "With the country abuzz about this weekend's Super Bowl, Tampa Bay is busy cleaning up the streets to host out-of-towners for the big game. That is, by conducting homeless sweeps and 'aggressively' jailing unhoused people.

Shame on Tampa Bay... seems we've got another case of 'hiding the homeless' on our hands."

I know city budgets are drained because of the economic crisis but we still should be treating these homeless people better. The city of Tampa stands to make millions from this game. I would imagine that it costs more to jail someone than sending them to a homeless shelter.

Man Sues Hooters for the Right to be a, "Hooters Boy!"

Inside of a Hooters restaurant in Chattanooga,...Image via WikipediaHouston - Hair Balls - Man Wants To Lick Hooters (In The Courtroom): "Nikolai Grushevski, a man from Corpus Christi, has filed a lawsuit because Hooters wouldn't let him work as a waiter, which we guess would be called a Hooters Boy."

Talk about frivolous lawsuits! Clearly this is an attempt to extort money from the franchise because no one who actually goes to Hooters is gonna want to see this dude dressed up in tight shorts. The amount of court time that will be wasted during this fiasco could be better used on way more important matters.

Unfortunately he has a good chance of winning or at least settling out of court just to save Hooters ongoing legal fees.

Fat Cats Got Bailed Out But Real Workers Get the Shaft

United Auto WorkersImage via WikipediaAuto bailout bill dies in Senate - CNN.com: "Senate Minority Leader Mitch McConnell said the sticking point was the United Auto Workers' refusal to set a 'date certain' to put employees at U.S. auto manufacturers at 'parity pay' with U.S."

WTF - Shouldnt politicians be more covert about their ignorance and greed? The jobs of millions of hard-working Americans are on the line while capitol hill fights itself. The president of the UAW in on live right now and is attempting to remind us all about the fact that unions are the one thing that gives real workers a voice.

Spying on pacifists, environmentalists and nuns - Los Angeles Times

The Constitution in PerilImage by Renegade98 via FlickrSpying on pacifists, environmentalists and nuns - Los Angeles Times: "Maryland officials now concede that, based on information gathered by 'Lucy' and others, state police wrongly listed at least 53 Americans as terrorists in a criminal intelligence database -- and shared some information about them with half a dozen state and federal agencies, including the National Security Agency.
Among those labeled as terrorists: two Catholic nuns, a former Democratic congressional candidate, a lifelong pacifist and a registered lobbyist. One suspect's file warned that she was 'involved in puppet making and allows anarchists to utilize her property for meetings.'"Read the rest here Spying on pacifists, environmentalists and nuns

We expect some errors, after all, they are human too but obviously some of them didnt use their brains. I mean, considering all the millions and millions of people they must be gathering information on these few errors dont seem that bad, lol

I am surprised they did not send the swat team into the church to arrest those nuns. I still can not believe they gave CIA director Tennet a medal after one of the biggest intelligence mistakes in history. I do believe he must have done some good for us during his stay, but we still havent gotten to the bottom of this issue.
